NATOA Files Brief in Appeal of FCC Cable Franchise Order
On May 29th, NATOA, the City of New York, the Florida League of Cities and several other Florida cities, filed a brief as intervenors in the litigation challenging the FCC’s 2019 Third Report and Order, which allows cable operators to deduct from franchise fees the fair market value of cable franchise requirements and largely preempts states and local governments from regulating the non-cable services and equipment of franchised cable operators. The brief is intended to compliment the excellent briefs filed by the many local government petitioners in this case, which did an outstanding job of addressing the many legal issues raised by the Order.
Briefing in this case will continue over the summer and wrap up in October. A decision is not expected until sometime in 2021.
